GENERAL TERMS AND CONDITIONS OF SALES

1 General

These Terms and Conditions apply to the sale and delivery of goods by the MAK Design Shop that is operated by the MAK - Austrian Museum of Applied Arts / Contemporary Art. The Purchaser’s differing terms and conditions will only be valid provided the MAK Design Shop has approved them in writing. By placing an order, the Purchaser agrees to accept these Terms and Conditions.

Your order will be saved for one year after its receipt.

2 Prices

Unless otherwise indicated, all prices are gross prices “ex works” including VAT at the statutory rate plus shipping costs. The prices will apply until revoked.

No VAT will be charged on sales to customers outside the EU. However, the Purchaser will be responsible for import duties that are levied by his country of domicile. No Austrian VAT is payable on sales to businesses within the EU provided they quote their VAT ID, but they must pay the VAT in their country of domicile.

3 Shipment / Contract Conclusion / Delivery Times

Shipping charges are according to recent fees of the Österreichischen Post AG and its worldwide partners for letter- and parcelservices. 
Thus shipping charges will depend on the weight and/or size (shape) of the shipment including packaging and the shipping destination. If you have any questions concerning shipping charges on a certain order-number, feel free to contact us at [service@makdesignshop.at].

Delivery times are shown in the list below:

Austria: 1 - 3 weekdays
Germany: 2 - 4 weekdays
Rest of Europe: 3 - 14 weekdays
Rest of World: 7 - 21 weekdays

Shipment takes place at the purchaser's expense and risk.

The order is deemed to have been accepted when it is shipped by the MAK Design Shop. Shipment takes place at the Purchaser’s expense and risk. Delays caused through delivery difficulties cannot be excluded.

If the MAK Design Shop is unable to complete an order within two weeks, or if the order cannot be accepted for any other reason, the MAK Design Shop will notify the Purchaser within 2 weeks of the order.

In the event of damaged or incomplete deliveries, the Purchaser must obtain confirmation from the deliverer. If goods arrive at the Purchaser in a defective state, despite having been properly packaged, the Purchaser must immediately notify the MAK Design Shop. Statutory warranty rules shall apply.

4 Payment Methods

a) Payment by credit card: Euro Card/ Master Card, Visa, Diners, American Express

b) Maestro

c) Payment by pro forma invoice: you will receive a pro forma invoice and after receipt of your payment the goods will be shipped to you.

5 Right of Withdrawal

The Purchaser may withdraw from the contract by returning the goods within 10 working days (Saturday is not considered to be a working day) following their receipt. Proof of posting (postmark) of the notice of withdrawal will suffice.

The goods must be returned to the MAK Design Shop in a resaleable condition, in their original packaging and postage paid, together with the notice of withdrawal. Goods are returned at the Purchaser's risk. If they have been used, a reasonable charge must be paid for their use. If the goods have deteriorated (e.g. through clear traces of use) or have been lost before being returned, the Purchaser must reimburse their reduction in value or the full value of the goods.

6 Reservation of Title

The MAK Design Shop retains title to the goods until they have been paid for.

7 Place of Jurisdiction

The place of performance for all clauses of the contract is Vienna.

This agreement is governed by Austrian law.

The contract language is German. This will remain the case even if the order is placed through the MAK Design Shop's Englich website.
